Almost every week, a client comes to me and says: “Someone owes me money, breached a contract, or won’t return my deposit. I want to sue them!”

After I explain the legal process and costs, they hesitate and ask: “Is there any other way?” I say, maybe I can send a lawyer‘s letter on your behalf.

So here’s the question: Is a lawyer‘s letter always effective? Let me answer that today.

To be honest, a lawyer’s letter only works on reasonable people.

A lawyer‘s letter is not a court judgment – no one is legally required to obey it. But in China, a proper letter from a law firm can serve several practical purposes.

First, it signals that you mean business. A WeChat message can be ignored, but a stamped lawyer’s letter says, “I have hired a lawyer and I‘m willing to take further steps.” That signal alone creates pressure.

Second, it clarifies the facts and demands. Many disputes are simply misunderstandings. A lawyer’s letter clearly lays out what happened, what the law says, and what you want the other party to do. Sometimes, upon receiving it, the other side realizes they are in the wrong.

Third, it exerts real-world pressure. For businesses or people who want to live a normal life, receiving a lawyer‘s letter is unpleasant. They worry about their reputation, legal costs, and wasted time. Those concerns often push them back to the negotiating table.

Compared to litigation, a lawyer’s letter is much cheaper and faster. A lawsuit can drag on for months or even a year, requiring court fees, legal fees, and a huge amount of energy. A lawyer‘s letter typically costs a fraction of that, and you can get a response within days.

However, the limitation is clear: a lawyer’s letter only works on those who still care about something – their reputation, business relationships, or the fear of a lawsuit. If the other party has no assets, has already fled, or simply doesn‘t care, the letter will have little effect.

But to be fair, for such people, a lawsuit may not help much either. So a lawyer’s letter remains a low-cost option that might just solve the problem.
