AI as Evidence? CN Court Issues First Reprimand for Fabricated AI Images

A local court in Hubei Province has exposed and formally reprimanded a plaintiff for attempting to submit AI-generated photographs as evidence in a housing lease dispute, marking a significant case highlighting the challenges of artificial intelligence in judicial proceedings and China's firm stance on litigation integrity.

In May 2024, a person surnamed Li leased a property to a person surnamed Xiong. After the lease expired and a dispute over unpaid rent and utility bills arose, Li sued Xiong. During the trial, Li's litigation representative — his daughter, surnamed Dong — was required to provide proof of the utility meter readings from before and after the tenancy.

Dong promised to submit photographs of the meters. However, the images she presented bore a clear watermark reading "generated by Doubao AI", immediately alerting the presiding judge. Upon further questioning, Dong's account of the meter usage became inconsistent, and she ultimately admitted to fabricating the evidence, later submitting genuine photographs.

The Dawu County People's Court clarified that using AI-generated content as litigation evidence constitutes the fabrication of key evidence, an act that can obstruct judicial proceedings. Under China's Civil Procedure Law, such misconduct can lead to serious consequences including fines, detention, or even criminal liability in severe cases.

Considering that Dong voluntarily confessed and corrected her actions, the court issued a formal reprimand based on the principle of combining punishment with education. The fabricated evidence was excluded, and the case will proceed based on verified facts. The court stated this demonstrates a "zero-tolerance" approach to safeguarding judicial authority.

This case serves as a stark reminder of the legal boundaries in the digital age. As AI tools become more accessible, the court's ruling reinforces that authenticity and integrity remain paramount in legal proceedings. This landmark decision sends a clear message about the serious consequences of attempting to deceive the judicial system with technologically fabricated evidence.
