A dispute triggered by the improper parking of an electric bicycle in a residential compound has been resolved through community mediation, underscoring the role of effective communication—particularly in cases involving foreign residents and language barriers.
Incident Escalates Over Misconduct and Miscommunication
At around 8 p.m. on a recent evening, resident Zhang was walking through a shared passageway in the underground garage of her residential building while carrying a young child. The passage connects a building entrance on the south side to a designated non-motor vehicle parking area.
While attempting to avoid an electric bicycle that had been improperly parked in the walkway by a foreign resident surnamed Jin (referred to here as "Jin"), Zhang fell and sustained an injury to her lower leg.
Zhang later sought medical treatment and incurred related expenses. She reported the incident to the police. During subsequent coordination efforts, Jin's inappropriate remarks and uncooperative attitude further escalated tensions, and negotiations failed. Zhang then opted to pursue legal action.
On March 4, following court referral, the case was formally accepted by the Nanhu District People's Mediation Committee.
Mediation Overcomes Language Barrier
After taking the case, the mediation committee reviewed medical records, expense receipts, and police reports, confirming that Jin's improper parking was the direct cause of the incident. Inappropriate comments made by Jin in a residents' online group were identified as a key factor in escalating the dispute.
Zhang indicated she was unable to communicate directly with Jin due to language barriers but provided information about his workplace. Recognizing that Jin did not speak Chinese, the committee identified communication as the primary challenge.
To address this, the committee contacted Wang, a colleague and friend of Jin, who agreed to act as an interpreter. This step enabled meaningful dialogue between the parties and allowed the mediation process to proceed.
Agreement Reached Through Coordinated Efforts
With Wang facilitating communication, the committee explained to Jin the safety risks associated with improper parking in shared spaces, emphasizing that such behavior can obstruct access and pose hazards to others. Jin was guided to acknowledge responsibility for both the incident and his earlier remarks.
At the same time, the committee worked to ease Zhang's concerns and encouraged both sides to resolve the matter through mutual understanding, avoiding further escalation.
After several rounds of negotiation focusing on compensation and the form of apology, both parties reached a voluntary agreement:
1. Jin issued a formal apology to Zhang via WeChat on March 10 for both the improper parking and his inappropriate remarks;
2. Jin compensated Zhang for her medical expenses via a WeChat transfer on the same day;
3. Jin committed to complying with community regulations and refraining from improper parking in the future.
Both parties accepted the outcome, and the dispute was successfully resolved.
