New Rules Proposed for Foreign Offenders in China
On September 8, a revised draft of the Prison Law was submitted for its second reading to the Standing Committee of the 14th National People's Congress (NPC). The new draft introduces significant changes concerning the execution and management of sentences for foreign national prisoners in China.

The updated provisions aim to safeguard the lawful rights and interests of foreign inmates, ensuring they are treated with fairness and justice throughout their sentence execution. Family visits for foreign nationals will be handled in accordance with existing national regulations. Furthermore, the transfer of foreign prisoners to their home countries will follow the relevant procedures set out under the International Criminal Judicial Assistance Law and other applicable laws.
The revised draft also introduces stricter norms for the conduct of prison officers. It explicitly addresses the misuse of police equipment or firearms and the unauthorized disclosure of work-related information. Disciplinary actions will consider the facts, nature, consequences, and the officer's intent to ensure fair and lawful accountability.
Another notable addition to the draft is the provision for pre-release education. Before a prisoner is released upon completing their sentence or receiving parole, prisons must provide a certain period of educational programming. This aims to reinforce rehabilitation outcomes and help inmates reintegrate into society smoothly.
In addition, the revised draft includes regulations for sealing the criminal records of juvenile offenders.
This marks the second review of the proposed amendments. The first draft was submitted to the 15th meeting of the 14th NPC Standing Committee in April 2025.
