China has announced new national rules for renting homes, called the Regulation on Housing Leasing. These rules will start on September 15, 2025. There are 7 chapters and 50 articles in total. The purpose is to:
Make renting more fair and organised.
Protect both renters and landlords
Keep rental relationships stable
Help the rental market grow better
Support renting and buying homes equally
Officials from the Ministry of Justice and the Ministry of Housing explained the main points to the public.
Main Rules for Renters and Landlords
1. Rental homes must be safe and livable:
Homes must follow building and fire safety rules.
Places like kitchens, bathrooms, hallways, balconies, basements, and garages cannot be rented out as bedrooms.
Local governments must set rules on how many people can live in one room and how much space each person must have.
2. Contracts must be clear and legal:
Both landlord and renter must use their real names and sign a written agreement.
All rental contracts must be registered with the local housing office.
3. Tenants get more protection:
Contracts must clearly show how much the deposit is, when it can be returned, and under what conditions money can be taken from it.
Landlords are not allowed to keep the deposit without a good reason.
If a landlord wants to end the lease, they must give fair notice and cannot use threats or violence to make tenants leave.
Rules for Rental Companies and Big Landlords
Rental businesses must follow these rules:
They must have enough money, staff, and good systems for managing rentals.
They must report details of their business to the local housing office.
Rental ads must be honest and not hide important facts.
They must keep records and protect personal data.
If they sublease homes (rent to others after renting themselves), all money must go through official rental accounts.
All rented homes must be reported to the local housing authority.
Big individual landlords included:
People who rent out many properties, like companies do, will also need to follow the same rules.
Better Supervision and More Transparency
To make sure the rules work well:
The government will provide standard contract templates for rentals and agent services.
Local governments must monitor rent prices and publish the data regularly.
Rental activities must be tracked through digital platforms and shared with other departments.
Industry groups are encouraged to help keep the market orderly.
