On July 4, Yichuan Subdistrict in Shanghai released a legal interpretation of common online shopping disputes involving foreign nationals.

During June's "Expats Explore Yichuan" event, a foreign participant sought legal assistance regarding an e-commerce dispute. With professional legal support, the case was efficiently resolved.

In this issue, we will systematically sort out the high-frequency legal issues that foreign friends encounter when shopping online in China and introduce practical legal knowledge to help you consume with peace of mind.

Defects in product quality

According to Article 1206 of the Civil Code, the platform is required to make compensation in advance. The platform has the obligation to manage and supervise the merchants in residence to ensure the quality of goods.

Keep screenshots of the product page and logistics records as evidence of rights protection, such as product photos, purchase time, delivery address, etc., so that sufficient evidence can be provided in case of disputes.

Fake and shoddy goods

When the purchased goods are found to be fake and inferior products, they can require the merchants to bear the responsibility of refunding one and compensating three according to the Consumer Rights and Interests Protection Law to safeguard their legitimate rights and interests.

Complain to the platform and ask the platform to punish the merchants, such as closing the store and deducting the deposit. At the same time, report to the market supervision department to crack down on fake and shoddy products.

Return and exchange disputes

Online shopping goods generally enjoy the right of seven days without reason to return or exchange goods, but it must meet the conditions stipulated by the platform and agreed by the merchant, such as the goods are not used, the packaging is complete, etc.

In case of disputes over returns and exchanges, timely communication and negotiation with the merchant shall be conducted. If no agreement can be reached through negotiation, mediation may be carried out through the platform customer service. Arbitration or litigation may be applied for if necessary.
