How the New Law Effectively Curb Juvenile Delinquency?
In recent years, the frequent occurrence of juvenile crimes, especially serious violent crimes committed by low-aged minors, and the significant increase in the number of juvenile delinquencies have aroused public concern.
In the recent discussions on the draft amendment to the Law on Public Security Administration Punishments, in accordance with the principle of combining education with punishment, the regulations on minors violating public security management have been further improved. The key points are as follows:
1. Adjusting the provisions on non-enforcement of detention appropriately to increase punishment targetedly. The amendment stipulates that for minors aged 14-16 and those aged 16-18 who violate public security management for the first time but with serious circumstances and bad influence, or minors aged 14-16 who violate public security management more than twice within a year, detention shall be enforced according to law.
In contrast, the current Law on Public Security Administration Punishments stipulates that administrative detention shall not be enforced for minors aged 14-16 and those aged 16-18 who violate public security management for the first time.
2. The amendment clearly states that for minors who are not given public security punishments due to insufficient age or for whom detention is not enforced, public security organs shall take corresponding correction and education measures in accordance with the Law on the Prevention of Juvenile Delinquency.**
3. Governing school bullying according to law. The amendment stipulates that for acts of school bullying such as beating, insulting, and intimidating, public security organs shall give public security management punishments according to law and take corresponding correction and education measures. At the same time, it is stipulated that if schools fail to report or deal with serious school bullying as required, they shall be ordered to make corrections, and relevant departments shall be recommended to impose sanctions on responsible personnel according to law, so as to give full play to the role of public security organs and schools in the collaborative governance of school bullying.
