Two foreign nationals who attempted to smuggle more than 70 kilograms of cannabis through China while transiting in Beijing, which have been sentenced to prison, after mistakenly believing that a short stopover would shield them from Chinese law.

The case was disclosed by the Fourth Branch of the Beijing People’s Procuratorate ahead of the International Day Against Drug Abuse and Illicit Trafficking. The two defendants were recently convicted of drug smuggling and sentenced to eight years and four years in prison, respectively. They were also fined and ordered to leave China after serving their sentences.

The case dates back to June last year, when an international flight stopped at Beijing Capital International Airport. During routine risk screening of passengers’ checked luggage, customs officers detected abnormalities in four pieces of baggage. The bags were intercepted and inspected, revealing more than 70 kilograms of suspected cannabis products.

Rapid on-site testing detected tetrahydrocannabinol (THC), a psychoactive compound found in cannabis. Customs authorities subsequently launched an investigation and identified the two foreign transit passengers. Investigators found that the defendants had allegedly agreed to transport cannabis overseas in exchange for illegal financial gains. Their plan was to transit through Beijing and eventually deliver the drugs to a third country.

Following weighing and forensic identification, the seized cannabis was confirmed to have a net weight of 70,830.9 grams, or approximately 70.8 kilograms. Prosecutors determined that the defendants had knowingly carried and transported the drugs into China, violating Chinese customs and drug-control regulations.

The defendants argued that they were merely transiting through China and that their final destination was outside the country. However, prosecutors stressed that this does not exempt travelers from Chinese law. Once prohibited drugs are brought into Chinese customs territory, the conduct may constitute completed drug smuggling, regardless of whether the traveler leaves the airport or whether the drugs are ultimately intended for another country.

The case also highlights a common misconception among international transit passengers: a transit stop is not a legal “grey zone.” Travelers and their luggage entering or passing through Chinese customs territory remain subject to Chinese laws and regulations.

Authorities have also warned of another growing risk. Overseas drug trafficking groups may lure people with promises of high payments to transport packages across borders. 

What appears to be a simple request to “carry something for someone else” can result in serious criminal consequences.

In this case, both defendants eventually made truthful statements and accepted the charges and penalties after prosecutors explained the relevant legal provisions and presented the evidence.

The case serves as a warning to international travelers: never accept unknown packages or luggage from others when entering or transiting through China. A short stopover does not place anyone outside the reach of Chinese law, and ignorance of the contents of a package may not protect a traveler from severe legal consequences.
