On December 11, the Leading Group for the Anti-Domestic Violence Joint Mechanism of Guangxi released its 2025 list of exemplary anti-domestic violence cases. One case drew particular attention for its timely and effective judicial protection of a foreign national who was a victim of domestic abuse.
Case Overview
The applicant, identified as Lu, is a Vietnamese citizen who registered her marriage in 2019 with Mo, a Chinese national. Following their marriage, Mo repeatedly subjected Lu to physical abuse. Lu reported the violence to the police on two occasions. Due to prolonged domestic violence, the couple separated. Lu has since been living alone in a shop she operates. Despite the separation, Mo continued to go to the shop to harass, assault, verbally abuse, and threaten her, seriously endangering her personal safety.
In March 2025, Lu sought judicial protection from the court. The court immediately activated its "Court+" multi-agency coordination mechanism. A judicial assistant fluent in Vietnamese provided bilingual legal services, explaining in detail the legal basis and application procedures for a personal safety protection order. At the same time, the court contacted the municipal Women's Federation, which assigned experienced anti-domestic violence staff to assist Lu throughout the process. With coordinated guidance from the court and the Women's Federation, Lu submitted her application for a personal safety protection order the following morning.
After reviewing the case, the court found that the police reports and photographs of Lu's injuries were sufficient to establish an imminent risk of domestic violence. To ensure maximum protection, the court issued a ruling on the day the case was accepted, granting a personal safety protection order that prohibited Mo from assaulting, threatening, harassing, stalking, or otherwise contacting Lu.
The protection order was promptly served on both parties, the public security authorities, and the Women's Federation. To ensure effective enforcement, the court convened a coordination meeting with the police and the Women's Federation to establish follow-up measures, including information sharing, rapid response, and regular follow-up visits. Psychological counseling was also arranged for Lu to help her cope with trauma and rebuild confidence.
To reinforce the deterrent effect of the order, the court worked with a deputy to the National People's Congress from Mo's village and a court-appointed mediator to provide legal counseling to Mo, clearly informing him of the illegality of domestic violence and the legal consequences of violating a personal safety protection order. Court officials, Women's Federation staff, police officers, and mediators continued to monitor Mo's conduct to ensure compliance. Subsequent follow-up confirmed that Lu suffered no further domestic violence after the order was issued and that her normal life had been restored.
Significance
The case exemplifies the judiciary's efficient and non-discriminatory protection of foreign victims of domestic violence. By providing bilingual legal services and tailored guidance, the court demonstrated a people-centered and humane approach to justice. The integrated "court–Women's Federation–police–people's congress deputy" collaboration mechanism established a comprehensive protection network, effectively addressing the practical challenges faced by foreign litigants and highlighting the strengths of coordinated social governance. Through swift case handling, robust enforcement, and sustained follow-up, the court effectively halted ongoing abuse, implemented the intent of China's anti-domestic violence legislation, and safeguarded both individual rights and social stability.
