According to the report, the incident occurred on the night of July 29 around 11:00 p.m. at a restaurant on Jile Road. The foreign individual, identified as Malik, reportedly confronted another customer, surnamed Tie, for smoking inside the restaurant—an act prohibited under Shanghai's public smoking laws.

Initial investigations revealed that Tie had agreed to stop smoking and was preparing to leave when he allegedly heard Malik utter what he considered an insulting remark. This sparked a verbal dispute between the two. Malik then began filming Tie and his friend, Zhang, with his mobile phone. Zhang, who claimed he was not directly involved, attempted to stop the filming and allegedly scratched Malik during the confrontation.

The Shanghai police confirmed they are continuing to investigate and will handle the matter in accordance with the law. They also stated that any violations of the public smoking ban by the restaurant would be handled by relevant authorities.

This incident follows a widely circulated video online showing a foreign man—reportedly the same Malik—asking patrons not to smoke indoors while pointing at a "No Smoking" sign. Malik has become known online for posting similar videos urging people to follow public smoking regulations.

Local media previously reported on Malik's efforts to stop indoor smoking and highlighted the relevant local law: The "Shanghai Smoking Control Regulations" prohibit smoking in all indoor public spaces, indoor workplaces, and public transport vehicles. The public is encouraged to report violations to supervisory authorities.

A staff member at the restaurant confirmed the incident, noting that employees also reminded patrons about the smoking ban. The staff added that the argument escalated quickly and included some physical contact. Police have already intervened, and full video footage is now under official review.

In a follow-up video, Malik confirmed that the case has been officially filed, showing documentation from the Minhang police.
