  Starting April 1, the Regulations on the Management of Public Security Video Image Information Systems will officially take effect. The new regulations aim to enhance public safety while safeguarding personal privacy and information rights.
Key Provisions
Prohibited Areas for Surveillance Equipment

  According to Article 8, it is strictly prohibited to install image collection devices and related facilities in the following public areas:

  1. Inside guest rooms or private rooms of hotels, inns, hostels, and homestays;

  2. Inside student dormitory rooms or rooms designated for accommodation or rest by internal personnel of an organization;

  3. Inside public restrooms, bathing facilities, changing rooms, nursing rooms, and fitting rooms;

  4. Any other areas where the installation of such devices could result in the unauthorized filming, eavesdropping, or invasion of privacy.

Installation and Operation Requirements
  Article 13 mandates that public security video system management entities must install surveillance equipment in a manner that balances public safety needs with privacy protection. The positioning, angle, and coverage of cameras should be carefully determined, and prominent signs indicating surveillance must be displayed. Failure to do so will result in corrective action ordered by public security authorities.
Use and Retention of Video Data
  • Article 16 stipulates that entities managing public security video systems must comply with laws and regulations, ensuring the protection of state secrets, trade secrets, and personal privacy. Misuse or unauthorized disclosure of video footage is strictly prohibited.
  • Article 17 requires that video footage must be retained for no less than 30 days. Once the intended purpose of the footage has been fulfilled, it must be deleted unless otherwise specified by laws or administrative regulations.
  • Article 21 grants individuals, their close relatives, or legal guardians the right to access relevant video footage if necessary to protect personal life, health, or property. However, any obtained footage involving public security, privacy, or personal information must not be unlawfully disclosed or publicly disseminated.
  • Article 22 emphasizes that when video footage is used for public dissemination, strict protective measures must be taken for sensitive personal information, such as facial images and vehicle license plates, as well as corporate identifiers like business licenses.
