Two Foreigners Sentenced to Jail & Deporting For Beating People!

On January 20th, according to China Judgements Online, two Moroccan men, YA and LB (both aliases), were sentenced to imprisonment and deportation for randomly intercepting, beating others and damaging others' properties.



As per the written judgement issued by the Wucheng District People's Court in Jinhua, Zhejiang, the defendants YA and LB were both born in 1997 and foreign students in a university located in Jinhua, Zhejiang.



What Happened


On August 14th, 2019, YA and LB attacked six people in half an hour and stole a scooter.


  1. At 5:50 on August 14th, YA and LB saw a Chinese guy jogging on the campus and they attacked him for no reason, which caused injuries to the man's face.


  2. Afterwards they walked out of the school. While crossing the sidewalk, YA hit another Chinese man who was passing by on a scooter on the face. The man fell down and injured his right ankle.


  3. Around 6 o'clock, YA and LB stopped a truck but failed to open the door by force. Thus, they climbed onto the top of the truck and YA smashed the cab glass by kicking it and hit the driver on his right cheek.


  4. Later, they entered an office building located in Xinshi Road. There, a woman came to inquire why they were there, and YA strangled her and dragged her into the bathroom. Hearing the noise, her husband rushed to there to rescue her. Seeing this, YA and LB first ran away from the window and then returned to beat the husband after seeing he was alone. YA sat on the husband after knocking him onto the ground and hit him on the head, causing a head injury.


  5. At about 6:15, YA and LB broke into a home and stole a black scooter. Not long after, YA knocked down a pedestrian and verbally abused him.


Later that day, both were arrested and detained by the police in the hall of the West Railway Station in Wucheng, Jinhua.

According to the Jinhua Public Security judicial appraisal center, all the above-mentioned victims were slightly injured. Later, the scooter was returned to the owner.

On October 15th, 2019, YAs family managed to compensate two of the victims and they reached an understanding.



The Defense


On October 25, 2019, the people's Procuratorate of Wucheng District, Jinhua, Zhejiang filed a public prosecution on the case to the people's Court of Wucheng. After the court accepted the case, it held a public hearing in accordance with the law.

According to the court's judgement and other relevant information, YA, the defendant, has no objection to the criminal facts and charges in the indictment. However, his lawyers put forward that: 1. YA s crimes were committed under the condition of being drunk, and the subjective malice was relatively small; 2. YA has confessed and pleads guilty in court; 3. His family has actively compensated some of the victims for their economic losses and obtained their understanding; 4. The defendant suffers from depression and is still under treatment. In conclusion, the court is requested to give it a lighter punishment.

LB, another defendant, also has no objection to the facts and charges of the crime in the indictment.



Courts Written Judgement


YA and LB beat others, damaged others' property and intercepted others at will to a flagrant extent. Their behaviors have constituted the crime of creating disturbances, and some of them are joint crimes. However, since they truthfully confessed the facts and pleaded guilty in the court, they are given a lighter punishment. Besides, YA has compensated two victims for their economic losses and obtained their understanding, so he is given a lighter punishment. 


In conclusion, according to the Criminal Law of the People's Republic of China, the judgement is as follows:


  1. The defendant YA is sentenced to one-year imprisonment and deportation.


    (Term of imprisonment: from August 14th, 2019 to August 13th, 2020).


  2. The defendant LB is sentenced to nine-month imprisonment and deportation.


    (Term of imprisonment: from August 14th, 2019 to May 13th, 2020).
