Landlords Could Be Fined for Not Registering Expats! Be Aware!

It seems that the landlords can easily get rent and live an easier life. However, if the landlordsincluding the managing staff of apartments) only wait to collect rent but fail to register the tenants information according to the regulations, they will get both financial and administrative penalties as per the Law of the People's Republic of China on Public Security Administration Penalties and Exit and Entry Administration Law of the People's Republic of China.

From March 15th to April 1st, 42 landlords in Fuyang District Hangzhou have got penalties for failing to register and report information on tenants (including Chinese and foreigners) in a timely manner as required.

What are the penalties for not registering information as required?

If the lessees information is not registered in accordance with the regulations, the landlord may be fined of 200 Yuan up to 500 Yuan in accordance with Article 57, paragraph 1 of the "Law of the People's Republic of China on Public Security Administration Penalties"; A fine of 200 Yuan may be imposed on the spot.

If the information of a foreigner who has not been registered as required, and is the first time, the landlord may be given a warning in accordance with Article 76, paragraph 1, item 6, of the Exit and Entry Administration Law of the People's Republic of China, and a fine of less than 2,000 Yuan may also be imposed. A fine of less than 500 Yuan may be fined on the spot.

Landlords who are caught for the second time or more for not registering the foreign tenants, may get a fine of less than 2,000 yYan, in accordance with paragraph 1 of Article 91 of the Anti-Terrorism Law of the Peoples Republic of China. In any of the following circumstances happen, it is determined as "causing serious consequences",  the landlord can be detained for more than 5 days but not more than 15 days:

  1. The tenants are identified related to terrorism;

  2. Criminal cases occur in the rental house;

  3. Not registering the information for more than 3 tenants (including 3) at a time;

  4. It is confirmed that the tenant is a person involved in terrorist and criminal activities.

In a summary, if the landlord fails to register or report in accordance with the regulations, the landlord may be fined (up to a fine of 2,000 Yuan) or detained (which can be detained for more than 5 days and less than 15 days).

What are the ways to submit information?

The landlords can report to the public security police station or community police office where the rental house is located; submit via WeChat/SMS/phone call, etc.; or submit online via  systems such as the self-service population information declaration system provided by the public security departments.

The landlords can report via Self-declaration system in the app called "Good Landlord", the landlords of rental houses, only need to log in to the system on their own mobile phone with WeChat and enter the corresponding rental house information. Information registration and reporting can be completed, without frequent visits to the police station.
